On May 24, 2008 the Houston Chronicle reported that Izza Lopez, a transgender woman has been award a settlement for wrongful termination. Lopez claimed that a Houston radiology company retracted their job offer because Lopez was born male. She reported that in 2005, River Oaks Imaging and Diagnostic offered her a job but took back their offer when they discovered that she had been born Raul Lopez Jr.

The company stated that the offer was taken back because Lopez did not present as a male even though she was born as one. U.S. district judge Nancy Atlas has ruled that "Lopez has stated a legally viable claim of discrimination as a male who failed to conform with traditional male stereotypes." Atlas entered an order on Tuesday which dismissed the lawsuit unless both sides can return with a finalized settlement but refused Oak's request to throw out the case entirely.
